1. Binding Agreement.

This Agreement sets out the terms and conditions (“Terms”) which apply to the ‘Refer and earn’ Programme (“Referral Programme”) offered by Lawbite (meaning Lawbit Limited, a company registered in the UK with company registration number 08066586 and whose registered office is at 39 Long Acre, London, England, WC2E 9LG “Lawbite”).

Please read these Terms carefully before you take part.  By participating in the Referral Programme, you are bound by these Terms and indicate your agreement to them.

If you do not agree to these Terms, you must not use our Referral Programme. You also cannot participate where by doing so, you would violate any applicable law or regulation.

2. Privacy.

The personal information collected, processed, and used as part of the Referral Programme will be used in accordance with Lawbite’s Privacy Policy, available here: https://www.lawbite.co.uk/privacy-policy

3. How our ‘Refer-and-Earn’ Programme works.

3.1. The Referral Programme offers eligible, existing clients of Lawbite (a “Referrer”) the opportunity to be compensated by way of a £150 credit (“Referral Credit”) when they make a referral as specified in these Terms to an individual (a “Referee”) who in turn instructs Lawbite with a legal case and pays the associated Lawbite fee.

3.2. To be eligible to be a Referrer, you must be over the age of 18, be an existing client of Lawbite and reside in or be a permanent resident of the United Kingdom.

3.3. Upon participation in the Referral Programme, the Referrer will be provided with a unique tracking link (“Unique Link”) which they can share via LinkedIn, WhatsApp, Facebook, Twitter or email. Where email is used, the Referrer shall enter the Referee’s email address and the Lawbite platform will send an automated email to the Referee. Referrers may not modify or contradict these Terms when sharing the Unique Link.

3.4. The Referee may sign up to the Referral Programme in any of the following ways:

  • 3.4.1. Via the landing page of the Unique Link;
  • 3.4.2. By calling LawBite and quoting the code contained in their Unique Link;
  • 3.4.3. Byapplying the code contained in their Unique Link at the checkout.

3.5. The Referee will then be credited with £50 (“Referee’s Credit”) to their Lawbite account when they sign up in one of the ways outlined at paragraphs 3.4.1 to 3.4.3 above. The Referee’s Credit may only be applied as a discount to the Referees’ first payable Lawbite subscription or to the Lawbite fees associated with the Referee’s first legal instruction to Lawbite (whichever is the earlier) and it shall not be payable in cash.

3.6. Upon payment by a Referee of their first Lawbite subscription or legal instruction to Lawbite (whichever is the earlier), the Referrer will be credited with £150 Referrer’s Credit to their Lawbite account. The Referrer’s Credit may only be applied as a discount to the Referrer’s current or future legal instructions with Lawbite. It may not be credited against any past Lawbite legal instructions or any past or future subscription payments and it shall not be payable in cash.

3.7. In the event that the Referee fails to provide the required identification and/or compliance information to Lawbite and/or the Referee is not accepted as a client of Lawbite for any reason, neither the Referrer’s Credit nor the Referee’s Credit shall be given.

3.8. Lawbite may require identification documents from a Referrer prior to granting the Referrer’s Credit and/or the Referee’s Credit. If these identification documents are not provided to Lawbite’s satisfaction, Lawbite may at its sole and absolute discretion withhold the Referrer’s Credit and/or the Referee’s Credit.

3.9. Each Referee referred to Lawbite through the Referral Programme will be entitled to only one Referee’s Credit and give rise to only one Referrer’s Credit. If a Referee receives more than one Unique Link, the Referrer whose Unique Link is used will receive the Referrer’s Credit, regardless as to when the Unique Links were shared.

3.10. Lawbite shall have the right at all times to refuse at its sole and absolute discretion to give either the Referee’s Credit and/or the Referrer’s Credit in the event that it suspects or has grounds to believe that either the Referrer or the Referee (i) have not used the Referral Program in good faith; or (ii) have breached these Terms.

3.11.Lawbite may determine at its sole and absolute discretion whether there has been a breach of these Terms. When a breach of these Terms has occurred, Lawbite may take such action as it deems appropriate, including (but not limited to) termination of any person’s participation in the Referral Programme, closing any person’s Lawbite account(s) and suspending or terminating the Referral Programme.

4. Restrictions on the use of the Referral Programme.

4.1. Participants may only use the Referral Programme in good faith and for lawful purposes.

4.2. Referrers may not:

  • 4.2.1. invite an existing client of Lawbite;
  • 4.2.2. invite fictitious persons or entities;
  • 4.2.3. do anything or allow anything to be done that damages Lawbite’s reputation, brand, or goodwill;
  • 4.2.4. use the Referral Programme in any way that breaches any applicable local, national or international law or regulation;
  • 4.2.5. use the Referral Programme in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose;
  • 4.2.6. transmit any unsolicited or unauthorised advertising or promotional material or spam. Bulk email distribution, distribution to strangers, or any other use of the Referral Programme in a manner outside of its intended purpose is expressly prohibited and may be grounds for further legal action. Referrers who do not comply with the law, including anti-spam laws, hereby specifically indemnify Lawbite against any liabilities, costs and expenses it may incur as a result of such spam.

5. Data Protection.

Referrers under this Referral Programme hereby represent and warrant that they have obtained the express consent from the individuals whose data they provide to Lawbite.

6. Limitation of Liability.

6.1. Lawbite accepts no liability for any use of the Referral Programme which does not comply with this Agreement.

6.2. Lawbite shall not be liable to any user of the Referral Programme for any direct, indirect, incidental, special, consequential, punitive or exemplary damages including (but not limited to) damages for loss of profits, goodwill, use, data or any other intangible losses.

6.3. By participating in the Referral Programme, participants agree to defend, indemnify, release and hold harmless Lawbite from any and all claims, actions, demands, damages, losses, liabilities, costs or expenses caused by, arising out of, in connection with, or related to their participation in the Referral Programme or their breach of these Terms.

6.4. Lawbite shall not be liable for any technical malfunctions or corruption, data theft, any printing or typographical errors, or any damage to any computer system resulting from the participation in, or accessing or downloading information in connection with, the Referral Programme.

6.5. Lawbite shall not be liable for failure to give any advertised credit by reason of any act of God, any action or request by any governmental or quasi-governmental entity (whether or not valid), or any other activity or action that is beyond Lawbite’s control.

6.6. Lawbite’s maximum liability arising out of or in connection with the Referral Programme whether in contract, tort, breach of warranty or any other cause of action, shall not exceed £100.

7. Changes to the Referral Programme.

LawBite reserves the right to:

  • 7.1. Change these Terms at any time by amending this page. Continued participation in the Referral Programme shall amount to acceptance of any Terms in force at that time.
  • 7.2. Terminate the Referral Programme at any time, without notice. In the event the Referral Programme is terminated, Lawbite will be under no obligation to credit any Lawbite accounts that would have otherwise qualified for a Referee’s Credit or a Referrer’s Credit.

8. Applicable Law.

8.1. This Agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation shall be governed by and construed in accordance with the law of England and Wales.

8.2. Each party irrevocably agrees that the Courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this Agreement or its subject matter or formation.
